These Terms of Use (“Terms”) govern your access to and use of the sonxit.co.za website (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Site.

These Terms constitute a binding agreement between you and SONXIT (Pty) Ltd. (“Sonxit”, “we”, “us”, or “our”) regarding your access and use of the Site. Your use of the site in any way constitutes your acceptance of these Terms.

We reserve the right, at its sole discretion, to modify or replace these Terms at any time. Such modifications will be effective immediately upon posting the revised Terms on the Site. Your continued use of the Site after the posting of any revised terms constitutes your acceptance of the revised Terms. We recommend you check the Terms periodically for updates.

3. User Accounts

You may be required to create an account (“Account”) to access certain features or functionalities of the Site. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify Sonxit immediately of any unauthorized use of your account or any other security breach. Sonxit cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

You agree to use the Site in a lawful manner and in accordance with these Terms. You agree not to:

  • Use the Site for any purpose that is unlawful or prohibited by these Terms.
  • Infringe upon the intellectual property rights of Sonxit or any third party.
  • Transmit any content that is harmful, threatening, unlawful, obscene, defamatory, hateful, or racially or ethnically offensive.
  • Interfere with or disrupt the servers or networks used to operate the Site.
  • Attempt to gain unauthorized access to the Site or any portion thereof.

5. Intellectual Property

The Site and all content and materials on the Site, including, but not limited to, text, graphics, logos, images, audio clips, video clips, software, data, and other information (collectively, the “Content”), are the intellectual property of Sonxit or its licensors. You may not modify, publish, transmit, reproduce, create derivative works from, distribute, display, or exploit in any way any of the Content without the express written permission of Sonxit.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING OR USAGE. SONXIT DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

SONXIT WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE CONTENT, EVEN IF SONXIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Termination

Sonxit may terminate your access to the Site at any time, for any reason, or no reason, with or without notice.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa.

10. Entire Agreement

These Terms constitute the entire agreement between you and Sonxit regarding your access and use of the Site.

11. Electronic Communications Consent

By providing us with your email address, you agree and consent to receive electronically all communications, agreements, documents, notices, and disclosures (collectively, “Communications”) that SONXIT (PTY) LTD provides in connection with our services. Communications may include:

  • Agreements and policies you agree to (e.g., Terms of Use and Privacy Policy), including updates to these agreements or policies.
  • Newsletters and promotional emails.

We will provide these Communications to you by emailing them to the primary email address you provide during signup.

  • How to withdraw your consent

You may withdraw your consent to receive Communications electronically by contacting us via the “Contact Us” link at the bottom of our website or by emailing us at info@sonxit.co.za. If you withdraw your consent, we may no longer be able to provide certain services to you.

  • Updating your contact information

It is your responsibility to keep your primary email address up to date so that SONXIT (PTY) LTD can communicate with you electronically. You understand and agree that if we send you an electronic Communication but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, SONXIT (PTY) LTD will be deemed to have provided the Communication to you.

Please note that if you use a spam filter that blocks or re-routes emails from senders not listed in your email address book, you must add SONXIT (PTY) LTD to your email address book so that you will be able to receive the Communications we send to you.
